The agreement between you and Providus Labs (Pty) Ltd for the use of ConstructionOS.

ConstructionOS is a construction management platform operated by Providus Labs (Pty) Ltd ("ConstructionOS", "we", "us"), a company registered in the Republic of South Africa under CIPC registration number 2026/142873/07. These Terms of Service ("Terms") govern your access to and use of the ConstructionOS web dashboard, mobile applications and related services (the "Service").
By creating an account, starting a trial, or using the Service, you agree to these Terms. If you are agreeing on behalf of a company, you confirm you are authorised to bind that company.
ConstructionOS provides tools for construction project management, including visual scheduling, field reporting, face-recognition attendance and timesheets, daily logs, punch lists, RFIs, safety and incident records, document management and client-facing PDF reports. We may add, change or remove features over time to improve the Service.
A "seat" is a login user of the Service (for example an owner, project manager or foreman). Your plan includes a number of seats and active projects as shown on our pricing. Workers tracked through face-recognition attendance are not seats and are not limited.
We offer a 14-day free trial with full Workforce-tier access. No payment card is required to start. At the end of the trial your account will move to a read-only state unless you choose a paid plan. We will not charge you automatically unless you have added a payment method and selected a plan.
All prices are stated in South African Rand (ZAR) and are inclusive of VAT where applicable. Paid plans are billed monthly or annually in advance. Annual plans are charged at the equivalent of ten months (two months free). Payments are processed securely by Paystack; card details are entered on Paystack's secure payment page and are never received or stored by us.
We may change our prices on renewal. Where we do, we will give you reasonable notice before the change takes effect.
You can cancel your subscription at any time from your account settings or by emailing us. Our full refund and cancellation terms are set out in our Refund & Cancellation Policy, which forms part of these Terms.
You agree not to misuse the Service. In particular, you must not:
You retain ownership of the data you put into the Service ("Customer Data"). You grant us a limited licence to process Customer Data only to provide and support the Service. Where you enable face-recognition attendance, ConstructionOS captures biometric data, GPS location and photographsand uses Amazon Rekognition to match faces; the app records each worker's consent before enrolment. As the employer and responsible party for your worksites, you are responsible for obtaining and maintaining that consent and for having a lawful basis to process worker data. How we handle personal information, including sub-processors and cross-border processing, is described in our Privacy Policy.
The Service is provided on a reasonable-effort basis. To the extent permitted by law, we exclude implied warranties and our total liability arising from the Service is limited to the fees you paid in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under South African law, including under the Consumer Protection Act where it applies.
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute, subject to any non-excludable consumer rights you may have.
